About this publication
While the form-based approach was once considered to be fundamental to competition analysis, this approach has since lost its appeal. The form-based approach has been replaced worldwide with the effects-based approach, which requires a consideration and analysis of the economic effects of firm behaviour. This necessitates an integration of economic theory into competition policy and regulation for a better understanding of competition law.
This text attempts to do precisely that.

Cornwell Dauds holds qualifications in law, tax, finance and accounting. He is a member of the Johannesburg Bar where he practises as an advocate. He was educated in South Africa and pursued postgraduate studies at Harvard Law School in the USA and London School of Economics in the UK.
